These Terms and Conditions of Business are between DistinctConnect Pty. Ltd. (“the Company”) and its clients (“Clients”). The acceptance of a Company resume, the introduction, the interviewing or placement of an applicant introduced by the Company will be deemed an acceptance by the Client of the Terms and Conditions set out herein. These Terms and Conditions may not be modified or varied except with the written agreement of a Director of the Company.
The recruitment fee payable per placement is a percentage of the total remuneration package on commencement (as per the Company’s Fee Schedule). The package upon which the fee is levied includes salary, motor vehicle (valued at $12,500 p.a), housing loan, superannuation, projected bonus/bonuses, commissions, and value equity/share profits expected to be given to the applicant within the first twelve months of employment.
The Client hereunder shall pay all placement fees due within fourteen (14) days of the start date shown on the invoice.
The Company provides a guarantee period of three(3) months in respect of permanent placements. In the event that any applicant terminates or the Client terminates their engagement within three(3) of the specified date upon which such applicant commences work for the Client, and provided that :
the Client notified the Company in writing of the termination of engagement within seven days thereof; and the Client or any subsidiary or associated company of the Client does not engage the applicant within twelve months from the date of termination of the engagement; and the termination is not due to retrenchment or relocation of the Client’s business; and all monies due from the Client have been paid in accordance with these Terms and Conditions and in the timeframe of the Company’s terms, then the Company shall replace, once only, free of charge, a suitable substitute within a period of no greater than six months. For the avoidance of doubt, the Company does not refund or credit monies. Furthermore, if the Client requires display advertising for this replacement, then the Client is liable for the costs of such advertising.
The Company will endeavor to ensure the suitability of any applicant introduced to the Client and to maintain a high standard of service and integrity, but the Company makes no warranty, express or implied, as to the suitability of any applicant introduced to the Client. Furthermore, the company shall not be liable for any loss, liability, damage, delay, costs, claims or expenses suffered or incurred by the Client arising from, or concerned with, the recruitment or engagement of any applicant by the Client, howsoever arising. Fees quoted do not include GST, which is applicable at the rate of 10% for all services delivered on or after 1 July 2000.
Fee Schedule for the placement of permanent staff
The following percentages apply as fees payable by clients of DistinctConnect Pty Ltd (“the Company”), for the placement of permanent staff by the Company using selection techniques. They are a percentage of the total annual remuneration package on commencement, as described in the Company’s Terms and Conditions of Business (Point 2 above).
Exclusive Assignment 10% of the salary package.
Non exclusive recruitment 15% of salary package.
